Frédéric Baldan, le citoyen belge de 35 ans qui a porté plainte contre Ursula von der Leyen dans l’affaire dite du SMSGate, fait-il l’objet de représailles de la Commission européenne ? Son accréditation de lobbyiste professionnel lui a été retirée en juin dernier par un impénétrable « secrétariat de la Transparence », pour d’obscurs motifs. Un évènement révélateur du fonctionnement d’institutions et d’administrations, celles de l’UE, qui n’œuvrent plus que pour elles-mêmes, dans l’intérêt de ceux qui les dirigent et en s’exonérant des règles de droit qu’elles ont elles-mêmes édictées. Ubu n’aurait pas fait pire.
Le 8 juin 2023, Frédéric Baldan répondait aux questions des journalistes lors d’une conférence de presse organisée par l’eurodéputée Michèle Rivasi (Europe Écologie les Verts), également vice-présidente de la commission spéciale Covid-19 (COVI). Pour mémoire, les membres de cette commission, mise en place pendant la pandémie afin de superviser les achats de vaccins, exhortent depuis plus de deux ans Ursula von der Leyen, présidente de la Commission européenne, à rendre publics les SMS qu’elle a échangés avec Albert Bourla, PDG de Pfizer. Des échanges intervenus dans le cadre des négociations du 3ème contrat d’achat du vaccin Comirnaty, comme Blast l’avait rapporté dans un précédent article.
Réquisitionner les SMS
Les membres de la commission COVI ne sont pas les seuls à réclamer, depuis des mois, le contenu de ces messages. La médiatrice de l’Union européenne (l’UE), Emily O’Reilly, le parquet européen et la Cour des comptes européenne les ont également demandés à Mme von der Leyen. En février 2023, c’est au tour du New York Times, le quotidien américain à l’origine du SMSGate, de saisir la Cour de justice de l’Union européenne (CJUE) afin de mettre la main sur ces textos. Exhortations auxquelles jusqu’à présent la présidente de la Commission est restée sourde.
Puissance de réalisation
En avril dernier, Frédéric Baldan, décide de placer la barre un peu plus haut en déposant une plainte avec constitution de partie civile contre Ursula von der Leyen en personne, pour « corruption », « usurpation de fonctions et de titre », « destruction de documents publics » et « immixtion dans des titres et fonctions ». Plainte déposée auprès d’un juge d’instruction de Liège qui sera « en mesure de réquisitionner les SMS et pas seulement de les demander », espère M. Baldan, qui estime subir un préjudice moral constitué par « la perte de confiance dans l’Union comme puissance de réalisation du bien commun » (1).
C’est dans ce contexte que le Belge était invité à la conférence de presse de Michèle Rivasi, début juin. Ses organisateurs entendaient faire le point sur l’ensemble des recours entrepris, afin que soient rendus publics ces échanges entre Mme von der Leyen et le PDG de Pfizer.
Quelques heures après l’événement, organisé dans l’annexe parisienne du Parlement européen, Frédéric Baldan recevait un mail lui notifiant la suspension temporaire de sa société de conseil, Cebiz SA, du registre de la transparence.
En tant que lobbyiste accrédité, il est en effet tenu d’y déclarer l’entité qu’il représente, les thèmes et politiques qu’il suit, et avec quel budget. L’inscription à ce registre est en effet obligatoire pour obtenir une accréditation permettant l’accès aux bâtiments du Parlement européen. Un peu plus de 12 000 organisations y figurent, depuis les PME jusqu’aux multinationales, en passant par les ONG ou les associations.
Le dirigeant de Cebiz SA est ainsi accrédité depuis six ans à travers cette société de conseil créée avec un associé de nationalité chinoise. Il est spécialisé dans les relations entre la Chine et l’Europe, dans le domaine de l’aviation civile (certification d’appareils, régulations, normes…). Les clients de Cebiz sont des PME qui n’ont pas les moyens d’avoir un lobbyiste « à demeure », ou n’en ont pas la nécessité. Elles passent donc par des cabinets de conseil comme celui de Frédéric Baldan.
« Je participe à des conférences publiques, je rencontre des personnes pas forcément pour les influencer, parfois c’est pour comprendre comment ils font la réglementation, où on en est dans le train législatif, qui les influence pour le moment », précise le lobbyste à Blast.
Des données déjà vérifiées 7 fois
Voilà pour le contexte. Mais revenons à ce 8 juin… Quelques heures après la conférence de presse. « Je reçois un mail m’indiquant que l’inscription de mon cabinet de conseil est suspendue temporairement pour une durée de 15 jours, rapporte Frédéric Baldan. On me reproche des « incohérences » dans ma déclaration, sans me préciser lesquelles ».
Cette suspension soudaine est d’autant moins compréhensible que Cebiz n’en est pas, on l’a vu, à sa première déclaration. « Cela fait six ans que j’encode les mêmes données avec les mêmes clients. J’ai fait mon renouvellement en avril dernier, donc ils les ont déjà vérifiées 7 fois ! J’aimerais comprendre pourquoi ma déclaration, cohérente en avril, est soudainement devenue incohérente en juin ».
Ce n’est pas tant l’absence d’arguments de fond qui fait bondir le lobbyste soudainement indésirable que la forme de cette missive, que nous avons consultée. Ce mail, qui a pour objet « Quality check of your registration » (Contrôle qualité de votre enregistrement), est signé par le « Secrétariat du registre de la transparence » (Secretariat of the Transparency Register). Avec l’adresse « TRANSPARENCY-REGISTER- CONTACT @europarl.europa.eu », le message ne comporte aucun nom ni aucune adresse postale, et ne propose qu’un simple formulaire de contact anonyme, comme possibilité de réponse.
« Ce message constitue une violation de l’article 41 des droits fondamentaux de l’UE relatif au droit à une bonne administration », oppose Frédéric Baldan. « L’administration doit motiver correctement ses actes. Dissimuler l’identité de l’agent qui traite votre dossier, c’est déjà un acte de maladministration. J’ai le droit de savoir, si on veut m’appliquer une sanction, qui instruit mon dossier, dans quel cadre, à la demande de qui et qui est cette personne ».
Des requêtes qui semblent de bon sens. « Elle doit m’indiquer, poursuit Frédéric Baldan, également quelle est ma voie de recours. Elle ne peut pas non plus m’imposer un mode de communication. Je veux répondre par un courrier recommandé avec accusé de réception, pas avec un formulaire anonyme qui, une fois envoyé ne me laisse aucune trace. Ils ne m’ont toujours pas donné d’adresse postale et le « Secrétariat du registre de la transparence » ne figure sur aucun organigramme ».
C’est délirant
Après avoir cherché auprès de quelle direction obtenir des informations, le lobbyste belge se tourne vers la « DG for security and safety ». Un service en charge notamment de la délivrance des badges d’accès au Parlement. La réponse, que nous avons également lue, indique que le registre de la transparence dépend de « services dédiés au sein du Parlement, de la Commission et du Conseil de l’Europe », et qu’il est géré par une coordination tournante qui est pour 2023 « le chef de l’unité chargée de la transparence au sein du secrétariat général de la Commission européenne. ». Autrement, derrière ces formulations parfaitement administratives, un service directement… sous les ordres d’Ursula von der Leyen.
« Ca me conforte dans le fait que tout cela est piloté, en conclut Frédéric Baldan. En plus, la réponse me renvoie à un « chef d’unité » qui n’existe pas non plus dans l’organigramme des institutions, et je ne sais toujours pas qui c’est. C’est délirant. »
Une parfaite coïncidence
Cette transparence version UE semble en effet bien nébuleuse. Au point de nous donner envie d’en savoir davantage sur ce mystérieux Secrétariat et sa gestion. Il nous aura fallu démêler un imbroglio digne de Kafka avant de comprendre qui gère la transparence au sein des institutions et finir par trouver, enfin, le nom de la responsable de ce fameux secrétariat du registre de la transparence. Profitant de nos recherches, Frédéric Baldan adresse en juillet dernier une mise en demeure dans laquelle il estime « de manière raisonnable que la seule explication rationnelle est que les procédures judiciaires et administratives initiées par Monsieur Baldan et à charge de Madame la Présidente de la Commission européenne (…) est la raison d’agir du secrétariat et le motif réel de la suspension de CEBiz SA du registre ».
Une interprétation niée par la responsable du Secrétariat, dans la réponse qu’elle lui adresse quelques jours plus tard : « En fait, toute allégation selon laquelle le Secrétariat du registre de transparence aurait agi sur instruction de « représailles » en raison de l’un quelconque de vos actes accomplis à titre personnel et sans lien avec l’enregistrement de votre organisation et ses activités déclarées de représentation d’intérêts est manifestement erronée (…). Le fait qu’il s’agissait de la même date qu’un évènement organisé à Paris par Michèle Rivasi, députée au Parlement européen, à laquelle vous avez participé́ à titre individuel, est une pure coïncidence, d’autant plus que cet évènement n’était pas lié aux activités de CEBiz ».
Le réveil du parquet européen
Coïncidence sans doute aussi, le parquet européen (EPPO) (2) annonce au même moment, début juillet, qu’il se saisit de la plainte déposée près de trois mois plus tôt par Frédéric Baldan, comme le rapportent nos confrères du média belge Le Vif.
En octobre 2022, pour rappel, le parquet européen avait annoncé l’ouverture d’une enquête sur l’acquisition des vaccins par l’Europe. Et puis, plus rien : le rapport d’activité 2022 de l’EPPO ne mentionne pas cette procédure.
Alors, faut-il se réjouir de cet intérêt soudain ? Pas si sûr, met en garde Maître Diane Protat, l’avocate de Frédéric Baldan. « Cette situation est inédite, car sur les 4 chefs d’inculpation, seul celui de « corruption » relève de la compétence de l’EPPO ». Pour l’instant, le juge d’instruction liégeois, Frédéric Frenay, est toujours en charge du dossier. « Mais comment les deux juridictions vont-elles fonctionner ? », s’inquiète Me Protat.
En effet, le Parquet européen, créé en 2021, a pour vocation la « lutte contre la fraude portant atteinte aux finances de l’UE ». La corruption, si elle génère une perte financière pour l’Europe, relève bien de ses compétences, mais ni « l’usurpation de fonctions et titres », ni la « destruction de documents publics » et encore moins « l’immixtion dans des titres et fonctions » (qui n’existe que dans le droit belge) n’en font partie.
Ni vous ni moi
La question se pose alors de savoir si cette saisine de l’EPPO n’est pas… une façon d’exclure Frédéric Baldan du dossier. En effet, selon Me Protat, les citoyens ne peuvent pas se plaindre des infractions qui relèvent du parquet européen : « ils ne peuvent pas saisir l’EPPO, en tant que victime. Il n’y a que l’Europe comme victime, ni vous ni moi. Que devient, alors, le statut de mon client ? ».
Mesures de rétorsion ?
Cette agitation autour de la plainte du citoyen Baldan est-elle le signe qu’elle est comme un caillou dans le soulier de la présidente de la Commission, probable candidate à sa propre succession en novembre 2024 ? À moins qu’elle ne préfère succéder à Jens Stoltenberg, dont le mandat de secrétaire général de l’OTAN expire, quant à lui, en octobre 2024.
Selon une indiscrétion du journal britannique Télégraphe rapportée par l’agence Nova en juillet dernier, l’actuelle présidente de la Commission serait même « le candidat préféré de Joe Biden ». Mme von der Leyen n’a pas encore fait part de sa décision.
En attendant, Cebiz n’a toujours pas été réintégré au registre de la transparence malgré les modifications apportées à sa déclaration, pour se conformer aux demandes du Secrétariat. Et Frédéric Baldan n’a toujours par récupéré son badge d’accès au Parlement.
Une façon de l’empêcher de prêter ses oreilles indiscrètes aux bruits de couloirs ? Et si tel était le cas, faudrait-il alors ajouter des « mesures de rétorsions » aux chefs d’inculpation sous le coup desquels se trouve déjà Ursula von der Leyen ?
